A pro se complaint by William Cline, plaintiff-appellant, for compensatory and punitive damages, filed in the United States District Court for the Western District of Kentucky at Owensboro on October 31, 1977, initiated this litigation, alleging violation of 42 U.S.C. § 1983. The courts jurisdiction was based on 28 U.S.C. § 1343 and declaratory relief was sought under 28 U.S.C. §§ 2201 and 2202. An amended complaint was subsequently filed. Named as defendants were Charles Norris and Bob Clary, jailers at the Daviess County Jail, who filed a motion to dismiss, supported by affidavits. Said motion to dismiss was overruled on December 5, 1977.
